How much notice is required for a repossession of a dwelling?
Short answer
In Quebec, the notice of repossession must be given 6 months before the end of the lease if the lease runs for more than 6 months, 1 month before the end if the lease runs for 6 months or less, and 6 months before the date of repossession if the lease is of indeterminate term.
In detail
These time limits are of public order: a notice given too late is not valid and does not permit the repossession on the intended date.
The tenant then has one month to accept or refuse. No reply amounts to a refusal. The landlord then has one month to file an application with the Tribunal administratif du logement (TAL, Quebec's rental board), counted from the refusal or from the expiry of the reply period.
If the TAL authorizes the repossession, it may impose fair and reasonable conditions, including payment to the tenant of an indemnity covering moving expenses.
What to document
The date on the notice, the date you received it, the end date of your lease, and the date of your reply. Also keep your moving invoices if the repossession goes ahead: they are what you use to claim the indemnity.
