Proposed order

Prepare proposed order using your own facts, evidence and verified legal grounds.

Québec small claims only: requested relief is not an issued court decision. This app’s PDF or Word draft does not grant an order or replace an official application.

If you need to make an application during an existing small-claims proceeding, check whether SJ-1268A applies. It is not for initial claims or incidental applications related to execution of a judgment.

No app purchase is needed to access these resources. Signing, swearing, filing and notification remain separate official steps; an export here does not perform them.

What you will prepare

  • Procedural history and existing orders
  • Orders or relief requested

Information to have ready

Case reference, court and jurisdiction, party names, author contact details, relevant dates and your supporting exhibits. Provide verified legal grounds where requested; the tool does not invent authorities or facts.

Review before filing

Confirm that this document is appropriate for the proceeding, use any mandatory official form, check confidentiality and redactions, and complete required signatures, swearing and service. A draft export is not a filing or proof of service.

Québec small claims: requested relief and an actual court decision

This checklist concerns Québec small claims only. The generic PDF or Word draft is neither an issued judgment nor the official SJ-1268A application. It does not confer court approval, and other proceedings require separate review.

  1. Confirm the proceeding and its stage before choosing a form. SJ-1268A concerns an application during Québec small-claims proceedings; it excludes initial claims and incidental applications related to execution of a judgment. Use actual parties and existing court-file identifiers; never invent a file number or an issued decision.

  2. Describe each result you are asking the court to grant. Keep requested relief separate from an outcome already decided. Label proposed wording clearly as a request; drafting it does not establish that the court has granted it or that the request is legally available.

  3. Set out relevant factual grounds with dates and supporting references. Distinguish personal observations, statements reported by others and interpretations. Name the source of each detail; leave missing information and uncertain dates explicit instead of converting assumptions into facts.

  4. Keep legal arguments separate from factual statements and requested relief. Identify the source of any rule you rely on and verify that it applies to this proceeding. Record unresolved legal questions for review. This worksheet does not select a certain legal strategy or establish entitlement to the requested result.

  5. For an existing decision, consult the actual judgment or obtain a copy through the official channels. Attribute quotations to that decision, identify the relevant passage and preserve its wording. Clearly label your summary or interpretation. Do not present a proposal, reconstructed wording or an example as an authentic court ruling.

  6. If SJ-1268A applies, follow its current signing and sworn-statement instructions with a person authorized to administer oaths, then its registry and notification process. The form assigns notification to the clerk. Verify applicable dates with the court office; this guide sets no general response deadline. Keep actual acknowledgments. An export neither signs, swears, files nor notifies, and does not guarantee acceptance or a court decision.
