Ontario affidavit preparation worksheet (Form 4D)
Organize your facts before completing the prescribed form. This tool exports a preparation worksheet; the official blank Form 4D is available free from Ontario Court Services.
What you will prepare
- Material facts (one paragraph per fact)
- Evidence and exhibit references
Information to have ready
Case reference, court and jurisdiction, party names, author contact details, relevant dates and your supporting exhibits. Provide verified legal grounds where requested; the tool does not invent authorities or facts.
Review before filing
Confirm that this document is appropriate for the proceeding, use any mandatory official form, check confidentiality and redactions, and complete required signatures, swearing and service. A draft export is not a filing or proof of service.
From worksheet to official Form 4D
The app exports a preparation worksheet, not the prescribed Form 4D. A paid PDF or Word download remains unsigned and unsworn. The official blank form is available free from Ontario Court Services.
Confirm the proceeding. Form 4D belongs to Ontario’s Rules of Civil Procedure. Do not assume it is the form for a family, small claims, criminal or tribunal proceeding.
Prepare the deponent’s full name, municipality and county or regional municipality, and their capacity where they are a party or represent one. The document author is not necessarily the person who will swear the affidavit.
Write in the first person, with consecutive paragraph numbers and one factual statement per paragraph where possible. Distinguish personal knowledge from other information; check whether an applicable rule permits the other evidence.
Review each exhibit with the person taking the affidavit. A reference in this worksheet does not attach, authenticate or mark the exhibit. Rule 4.06(3) governs marking and the different treatment of attached and produced exhibits.
Transfer the reviewed content into the official form. Arrange swearing or affirmation with an authorized person, including the appropriate in-person or video-conference jurat. Leave signatures and commissioning details for that process. Verify service, filing and any local directions separately.
