Lessee’s reply to a lessor’s notice (rent increase or modification, repossession, eviction) or notice of non-renewal

Prepare the written reply that the Civil Code requires, in the language of the lease, with the TAL notice models as reference; you sign it and keep proof of receipt.

What you will prepare

  • Notice received: nature (modification of the lease / repossession / eviction) and date of receipt — or no notice received (non-renewal, art. 1946)
  • Address of the leased dwelling; lessor(s) concerned
  • Your answer, in your own words (e.g. accept; refuse the modifications and renew; not renew and leave at the end of the lease; comply with a repossession or eviction notice or refuse to leave)
  • If you leave: date (end of the lease)
  • Language of the lease (the notice is given in the language of the lease, art. 1898)

Information to have ready

Sender and recipient names and addresses, letter date, proposed delivery method, relevant facts, requested remedy and supporting records. No court caption is required by this drafting tool.

Review before sending

Check the facts, amount and requested remedy, applicable requirements, recipient, confidentiality and signature before sending. Arrange delivery yourself and keep its evidence. Exporting a draft does not send the letter or prove receipt.

The official reference below concerns Québec only. For another province, verify its applicable requirements. The tool does not supply a universal response deadline.

Fictional writing examples

Examples are inspiration only. Replace every detail with your verified facts; opening an example never adds it to your case.

Notice received: nature (modification of the lease / repossession / eviction) and date of receipt — or no notice received (non-renewal, art. 1946)

Write the nature and date of receipt of the notice. The one-month time for replying runs from the receipt (arts. 1945, 1962). Example (fictional): notice of rent increase received on 2 March 2026.

Address of the leased dwelling; lessor(s) concerned

The TAL models address the notice to each lessor concerned, with the address of the leased dwelling.

Your answer, in your own words (e.g. accept; refuse the modifications and renew; not renew and leave at the end of the lease; comply with a repossession or eviction notice or refuse to leave)

TAL-810-E offers three answers (accept the renewal with the modifications; refuse the modifications and renew; not renew and leave at the end of the lease); TAL-811-E and TAL-826-E offer two (comply and leave, or refuse to leave). Write the one you choose.

If you leave: date (end of the lease)

The date the lease ends, as written in the lease (TAL-807-E: “Je quitterai les lieux au plus tard à la fin du bail le …”).

Language of the lease (the notice is given in the language of the lease, art. 1898)

Art. 1898: the notice is given in writing “at the address indicated in the lease or, after the lease has been entered into, at the new address of the party, if the other party has been informed of it” and is “drawn up in the same language as the lease”. “A notice that does not conform to the prescribed requirements may not be set up against the addressee unless the person who gave it proves to the court that the addressee has not suffered any injury as a consequence.”

What the provisions read require

  • C.C.Q., art. 1945 — Refusal or notice of departure “dans le mois de la réception” of the notice of modification; otherwise the lessee is deemed to accept (13-02). (LégisQuébec — Code civil du Québec, read on 2026-10-21)
  • C.C.Q., art. 1962 — French text: reply “dans le mois […] s’il omet de le faire, il est réputé avoir refusé” (repossession, eviction). (LégisQuébec — Code civil du Québec, read on 2026-10-21)
  • C.C.Q., art. 1946 — Non-renewal by the lessee “dans les mêmes délais que ceux que doit respecter le locateur” (13-02). (LégisQuébec — Code civil du Québec, read on 2026-10-21)
  • C.C.Q., art. 1898 — “Every notice relating to a lease, except notice given by the lessor with a view to having access to the dwelling, shall be given in writing at the address indicated in the lease or, after the lease has been entered into, at the new address of the party, if the other party has been informed of it; the notice shall be drawn up in the same language as the lease and conform to the rules prescribed by regulation. A notice that does not conform to the prescribed requirements may not be set up against the addressee unless the person who gave it proves to the court that the addressee has not suffered any injury as a consequence.” (LégisQuébec, up to date as of 15 October 2026, read on 2026-11-03) (LégisQuébec — Code civil du Québec, read on 2026-10-21)
  • C.C.Q., art. 1955, para. 3 — “Those restrictions may not be set up by the lessor against the lessee unless they are set out in the lease and, in the case of a dwelling referred to in the second paragraph, unless the lease indicates the maximum rent that the lessor may impose in the five years after the date on which the immovable is ready for its intended use.” Para. 4: those rules do not apply to a dwelling that has been the subject of a change of destination referred to in art. 1955.1 (read on 2026-11-03). (LégisQuébec — Code civil du Québec, read on 2026-10-21)
  • TAL-810-E (2026-05) — French text: refusal of the modifications obliges the lessee to leave at the end of the lease when the lease section on restrictions indicates a housing cooperative, or a building constructed or converted five years ago or less (arts. 1945 and 1955 C.C.Q.).
  • TAL notice models — The models state that the lessee keeps a copy and a proof of receipt of the notice given. (Tribunal administratif du logement — Modèles d’avis, read on 2026-10-21)

Time limits read

  • Within one month of receipt of the notice (C.C.Q., arts. 1945, 1962); non-renewal: within the time limits of art. 1942 (art. 1946). The tool does not compute dates (computation: TAL Act, s. 87).

Exhibits and documents

  • Copy of the notice received and of the lease; proof of receipt of your reply (registered mail or acknowledgement).

To verify (not read or not settled)

  • Whether a restriction of section F of the lease applies (cooperative, new building): read on the lease itself; for a new building, the lease must also indicate the maximum rent (C.C.Q., art. 1955, para. 3).
  • Exceptions to the eviction prohibition (TAL-826-E, verso): not transcribed.

Help preparing the reply (category B, with the TAL notice models as reference). The answers and notes come from TAL-810-E, 811-E, 826-E and 807-E re-read on 2026-10-21; C.C.Q. arts. 1945, 1946 and 1962 are quoted as read by research 13-02; art. 1898 was re-read on LégisQuébec on 2026-11-03. The TAL models are optional: the Code requires a written notice. Québec statutes and most Québec sources linked here were read in French; English wording in this guide is an unofficial summary unless an official English text is linked.
