Formal notice (Québec, C.C.Q., arts. 1594-1595)

Prepare a formal notice that you send for yourself, with the variants for a latent defect, housing, a merchant or a card issuer.

What you will prepare

  • Variant: general; written notice of a latent defect (C.C.Q., art. 1739); housing (lessor or lessee); consumer (merchant); credit card issuer (follow-up to CPA, s. 54.16)
  • Subject
  • The facts, dated (one sentence per fact)
  • What is demanded (exact amount or act to perform)
  • Time allowed for performance (C.C.Q., art. 1595: “un délai d’exécution suffisant”)
  • Documents referred to (P-1, P-2…)

Information to have ready

Sender and recipient names and addresses, letter date, proposed delivery method, relevant facts, requested remedy and supporting records. No court caption is required by this drafting tool.

Review before sending

Check the facts, amount and requested remedy, applicable requirements, recipient, confidentiality and signature before sending. Arrange delivery yourself and keep its evidence. Exporting a draft does not send the letter or prove receipt.

The official reference below concerns Québec only. For another province, verify its applicable requirements. The tool does not supply a universal response deadline.

Fictional writing examples

Examples are inspiration only. Replace every detail with your verified facts; opening an example never adds it to your case.

Variant: general; written notice of a latent defect (C.C.Q., art. 1739); housing (lessor or lessee); consumer (merchant); credit card issuer (follow-up to CPA, s. 54.16)

Write the variant. A latent defect is denounced in writing “dans un délai raisonnable depuis sa découverte” (art. 1739). For a merchant, the OPC also publishes an optional form (09-2021).

Subject

One line naming the matter, e.g. “Unpaid invoice no. 2026-014 of 12 March 2026” (fictional).

The facts, dated (one sentence per fact)

Who owes what, why and since when; each fact dated, with the document it refers to. Take the dates from your log.

What is demanded (exact amount or act to perform)

An exact amount or a precise act, e.g. “pay the sum of $200” or “carry out the repair of the roof”.

Time allowed for performance (C.C.Q., art. 1595: “un délai d’exécution suffisant”)

Art. 1595 requires a sufficient time “eu égard à la nature de l’obligation et aux circonstances”; the law sets no number of days. You choose it and write it here; the letter prints no other date.

Documents referred to (P-1, P-2…)

List the documents attached or referred to, with their numbers.

Category and limits

Complete template to fill in yourself · category A · practice area : Civil litigation · offered in case files of type : Other (small claims, neighbours…), Housing, Business, Claim against a municipality, Civil litigation, Consumer & small claims

Complete template that you fill in for your own file. The fixed text only carries the mentions the cited provisions require; the facts, choices and requests are yours. The tool does not file, serve, swear or send anything, does not choose a remedy or a deadline for you, and guarantees no outcome (Act respecting the Barreau du Québec, s. 128: “to prepare and draw up a notice, motion, proceeding or other similar document intended for use in a case before the courts”, “performed for others”, is the exclusive prerogative of the practising advocate or solicitor).

What the provisions read require

  • C.C.Q., art.
  • Québec.ca — Mise en demeure — Elements recommended by Québec.ca (not required by law): date, recipient, “SOUS TOUTES RÉSERVES”, mode of sending, the words “mise en demeure”, summary, demand, time limit, contact information and signature; keep the proof of receipt. (Gouvernement du Québec — Mise en demeure (petites créances), read on 2026-10-21)
  • Act respecting the Barreau du Québec, s. 128, para. 2 e) — Reserved to lawyers when done for another person: “faire de la perception ou réclamer avec frais ou suggérer que des procédures judiciaires seront intentées”. The template is offered for the author’s own case. (LégisQuébec — Loi sur le Barreau, B-1, read on 2026-10-15)

Time limits read

  • The law requires a “sufficient” time (art. 1595) without fixing a number of days; a latent defect is denounced within a reasonable time from its discovery (art. 1739).

Exhibits and documents

  • Invoice, contract, photos referred to; proof of sending (registered mail, bailiff, or email with acknowledgement according to the TAL).

To verify (not read or not settled)

  • Offered for the author’s own case only; in Practice mode, a letter for a client is the lawyer’s act (s. 128) — to confirm with the reviewing lawyer (lexicon § 9).
  • The app template “miseEnDemeure” (app.js) is kept unchanged; its fields map to this template through legacyFieldMap.

Complete template (category A), upgrade of the app template “miseEnDemeure” (identifier kept as legacyIds). C.C.Q. arts. 1595 and 1739 are quoted as read by research 13-02; the Québec.ca, TAL and OPC pages answered HTTP 200 on 2026-10-21. Québec.ca publishes an example letter, not an official form. Québec statutes and most Québec sources linked here were read in French; English wording in this guide is an unofficial summary unless an official English text is linked.

Preuve en main is a preparation and legal-information tool. It gives no legal advice, replaces neither a lawyer nor the official form, and guarantees no outcome.
