Draft agreement — to be submitted for homologation

Prepare a draft family agreement with the declarations required by the Code of Civil Procedure; the court decides whether to homologate it.

What you will prepare

  • Resources and situation of the parties (family rules, art. 25), unless the parties file Form III or the child-support determination form
  • Parenting time and decision-making responsibilities (parenting plan, Divorce Act s. 16.6(2)); for unmarried parents: custody and parental authority
  • Child support: amount from the determination form and, if the agreed amount differs, the precise reasons for the difference (C.C.P., art. 448)
  • Declaration of a party who receives, or received during the period covered, benefits under a social assistance, social solidarity or basic income program (C.C.P., art. 449)
  • Family patrimony or parental-union patrimony: partition, or renunciation (judicial declaration or notarial act); retirement-rights confirmation (family rules, art. 28)
  • Collection of support by Revenu Québec, or request for exemption (Act to facilitate the payment of support, s. 3)
  • Other agreed terms (support between spouses, compensatory allowance, other)

Information to have ready

Case reference, court and jurisdiction, party names, author contact details, relevant dates and your supporting exhibits. Provide verified legal grounds where requested; the tool does not invent authorities or facts.

Review before filing

Confirm that this document is appropriate for the proceeding, use any mandatory official form, check confidentiality and redactions, and complete required signatures, swearing and service. A draft export is not a filing or proof of service.

Category and limits

Complete template to fill in yourself · category A · practice area : Family · offered in case files of type : Family

Complete template that you fill in for your own file. The fixed text only carries the mentions the cited provisions require; the facts, choices and requests are yours. The tool does not file, serve, swear or send anything, does not choose a remedy or a deadline for you, and guarantees no outcome (Act respecting the Barreau du Québec, s. 128: “to prepare and draw up a notice, motion, proceeding or other similar document intended for use in a case before the courts”, “performed for others”, is the exclusive prerogative of the practising advocate or solicitor).

What the provisions read require

Time limits read

  • No deadline specific to the agreement was read; in joint applications all exhibits are filed with the application (art. 21).

Exhibits and documents

  • Child-support determination form of each parent and declarations under art. 444.
  • Birth certificates; marriage certificate in a divorce.
  • Mediator’s report, if any; sworn statements of the parties (model 3 of the 2021 brochure).

To verify (not read or not settled)

  • The Ministry brochures (December 2021, July 2022) predate the Unified Family Court and the parental union; the court seized depends on art. 37.2 C.C.P.
  • C.C.P., art. 454 (homologation): text not quoted, to be re-read.
  • Registration of a renunciation in the RDPRM (C.C.Q., arts. 423, 521.41): form NOT READ (site blocked, HTTP 403).

Complete template (category A), titled as the lexicon requires: “Draft agreement — to be submitted for homologation”. The mentions of C.C.P. arts. 415, 430, 448 and 449 and of the family rules are quoted as read by reports 06 and 13-01. The agreement takes effect only as the court decides. Québec statutes and most Québec sources linked here were read in French; English wording in this guide is an unofficial summary unless an official English text is linked.
