Small claims application (SJ-870E online) — help preparing your answers

Prepare, before going online, the content that art. 544 C.C.P. requires in a small claims application; you enter it yourself in the online SJ-870E form.

What you will prepare

  • Parties: names and domicile (last known residence of the defendant)
  • Facts on which the claim is based
  • Nature of the claim
  • Amount of the claim and interest (no more than $15,000, without interest; the claim is not divided)
  • Conclusions sought
  • List of exhibits (P-1, P-2…; SJ-840)
  • Interest or not in mediation
  • Legal person only: declaration about no more than 10 persons (art. 544, para. 2)
  • Representation by a relative or friend, if a natural person is unable to act (art. 542; SJ-838)

Information to have ready

Case reference, court and jurisdiction, party names, author contact details, relevant dates and your supporting exhibits. Provide verified legal grounds where requested; the tool does not invent authorities or facts.

Review before filing

Confirm that this document is appropriate for the proceeding, use any mandatory official form, check confidentiality and redactions, and complete required signatures, swearing and service. A draft export is not a filing or proof of service.

Category and limits

Help preparing the official form · category B · practice area : Consumer & small claims · offered in case files of type : Other (small claims, neighbours…), Business, Consumer & small claims, Civil litigation

Help preparing the official form: the tool prepares your answers, line by line, and links the official form. You check each line, transfer it onto the official form, sign it and handle any oath, notification and filing yourself. The tool guarantees no outcome.

Official form

SJ-870E (formulaire en ligne); SJ-840, SJ-838 (SJ-840 (2023-06); SJ-838 (2015-11)) ↗

The SJ-870E is an online form behind authentication (its screens were not read) and Québec government content may not be reproduced without prior authorization (quebec.ca “Droit d’auteur”, read on 2026-10-21). You enter the prepared answers yourself.

What the provisions read require

Time limits read

  • Exhibits within 10 days of filing (art. 545). The prescription period (generally three years, art. 2925 C.C.Q.) is not computed by the tool.

Exhibits and documents

  • Exhibits P-1, P-2… and their list (SJ-840).
  • Formal notice and its proof of delivery, if any.
  • Mandate SJ-838 if a relative represents you.

To verify (not read or not settled)

  • Screens of the online SJ-870E: NOT READ (authentication); to re-read before relying on this list.
  • Court costs and the regulation fixing the $5,000 mediation threshold: NOT READ.

Help preparing the official online form (category B). Art. 544 C.C.P. is quoted as read by research 13-02 (LégisQuébec, current to 12 August 2026); the Québec.ca pages were read on 2026-10-15 and answered HTTP 200 on 2026-10-21. The clerk may help you but gives no legal advice (art. 543). Québec statutes and most Québec sources linked here were read in French; English wording in this guide is an unofficial summary unless an official English text is linked.

Preuve en main is a preparation and legal-information tool. It gives no legal advice, replaces neither a lawyer nor the official form, and guarantees no outcome.
