Request to exchange income information (C.C.Q., art. 596.1)

Prepare the yearly written request that parents may make to each other under art. 596.1 C.C.Q., with the documents prescribed by the child-support rules.

What you will prepare

  • Judgment or agreement fixing child support: court, district, file number and date
  • Year concerned and any terms set by the court
  • Documents requested (those prescribed by the child-support determination rules)
  • Your own documents sent with this letter (art. 596.1 applies to both parents)

Information to have ready

Sender and recipient names and addresses, letter date, proposed delivery method, relevant facts, requested remedy and supporting records. No court caption is required by this drafting tool.

Review before sending

Check the facts, amount and requested remedy, applicable requirements, recipient, confidentiality and signature before sending. Arrange delivery yourself and keep its evidence. Exporting a draft does not send the letter or prove receipt.

The official reference below concerns Québec only. For another province, verify its applicable requirements. The tool does not supply a universal response deadline.

Fictional writing examples

Examples are inspiration only. Replace every detail with your verified facts; opening an example never adds it to your case.

Judgment or agreement fixing child support: court, district, file number and date

Example (fictional): Superior Court, district of Montréal, file 500-12-000000-000, judgment of 3 March 2025.

Year concerned and any terms set by the court

State the year concerned. Art. 596.1 allows the request “au plus une fois l’an, ou selon les modalités fixées par le tribunal”: copy those terms if the judgment sets any.

Documents requested (those prescribed by the child-support determination rules)

List read on the determination form: last provincial tax return and notice of assessment (or federal ones); the last three pay statements; financial statements; statement of income and expenses for an immovable; any other document used to establish income.

Your own documents sent with this letter (art. 596.1 applies to both parents)

List the documents you enclose, if any. Example (fictional): 2025 notice of assessment and last three pay statements.

Category and limits

Complete template to fill in yourself · category A · practice area : Family · offered in case files of type : Family

Complete template that you fill in for your own file. The fixed text only carries the mentions the cited provisions require; the facts, choices and requests are yours. The tool does not file, serve, swear or send anything, does not choose a remedy or a deadline for you, and guarantees no outcome (Act respecting the Barreau du Québec, s. 128: “to prepare and draw up a notice, motion, proceeding or other similar document intended for use in a case before the courts”, “performed for others”, is the exclusive prerogative of the practising advocate or solicitor).

What the provisions read require

  • C.C.Q., art. 596.1, para.

Time limits read

  • At most once a year, or according to terms set by the court (art. 596.1). No deadline to answer was read in art. 596.1; the letter prints none.

Exhibits and documents

  • Copy of the judgment or agreement fixing support.
  • Your own income documents, if you send them.

To verify (not read or not settled)

  • No legal deadline to answer was read (13-01, P1-2).
  • Use as an annex to a SARPA application (section 5 of its form) is not built here.

Complete template (category A). Art. 596.1 C.C.Q. is quoted as read by research 13-01 (LégisQuébec, current to 12 August 2026); the list of documents comes from the official determination form read on 2026-10-13. The letter asks; it does not threaten or predict anything. Québec statutes and most Québec sources linked here were read in French; English wording in this guide is an unofficial summary unless an official English text is linked.
