Cancellation of a distance contract and chargeback request (CPA, ss. 54.8-54.16)

Prepare either the notice of cancellation to the merchant (s. 54.11) or the written chargeback request to the credit card issuer (s. 54.15). Create one document per letter.

What you will prepare

  • Letter prepared: (1) notice of cancellation to the merchant (s. 54.11) or (2) chargeback request to the credit card issuer (s. 54.15)
  • Merchant, goods or service, website, date of the contract
  • Ground for cancellation and the case relied on (ss. 54.8, 54.9 or 54.9.1)
  • Amounts charged and amount to be refunded
  • Letter 2 only — date and mode of the notice of cancellation sent to the merchant
  • Letter 2 only — name of the cardholder (the card number and expiry date are left blank, to be written by hand)

Information to have ready

Sender and recipient names and addresses, letter date, proposed delivery method, relevant facts, requested remedy and supporting records. No court caption is required by this drafting tool.

Review before sending

Check the facts, amount and requested remedy, applicable requirements, recipient, confidentiality and signature before sending. Arrange delivery yourself and keep its evidence. Exporting a draft does not send the letter or prove receipt.

The official reference below concerns Québec only. For another province, verify its applicable requirements. The tool does not supply a universal response deadline.

Fictional writing examples

Examples are inspiration only. Replace every detail with your verified facts; opening an example never adds it to your case.

Letter prepared: (1) notice of cancellation to the merchant (s. 54.11) or (2) chargeback request to the credit card issuer (s. 54.15)

Write “Notice of cancellation of a distance contract” or “Chargeback request”. The second letter follows the first when no refund is received.

Merchant, goods or service, website, date of the contract

Example (fictional): Example Shop Inc., wireless headphones, example-shop.test, order of 3 September 2026.

Ground for cancellation and the case relied on (ss. 54.8, 54.9 or 54.9.1)

Describe the facts and cite the section. S. 54.9(a) (read on 2026-11-03): the consumer may cancel “at any time before performance of the merchant’s principal obligation if (a) the merchant’s principal obligation is not performed within 30 days after the date specified in the contract or the later date agreed on in writing by the consumer and the merchant, or within 30 days after the contract is entered into in the case of a contract that does not specify a date or time limit”. For ss. 54.8 and 54.9.1, read the section before relying on it.

Amounts charged and amount to be refunded

Each amount with its date, e.g. $189.99 charged on 3 September 2026 (fictional).

Letter 2 only — date and mode of the notice of cancellation sent to the merchant

Example (fictional): notice sent by email on 20 September 2026 (copy enclosed).

Letter 2 only — name of the cardholder (the card number and expiry date are left blank, to be written by hand)

Write only the cardholder’s name here. Never type the card number or expiry date in the app: the export leaves them blank, to be written by hand.
