Proof of notification (C.C.P., arts. 131-134; TAL Act, s. 56.2)
Prepare the sender’s declaration (mail), the transmission slip (technological means) or the proof filed at the TAL, with the mentions required by the provisions read.
What you will prepare
- Mode used: registered mail (art. 131), technological means (arts. 133-134), delivery by messenger (art. 132), or notification of a TAL application (TAL Act, s. 56.2)
- Nature of the document notified and file number
- Sender: name and contact information
- Recipient: name and contact information (address, email or fax number used)
- Place, date, hour and minutes of the sending or transmission
- Delivery or receipt status (Canada Post notice of delivery or of receipt, acknowledgement of receipt)
- Information to verify the integrity of a technological transmission (e.g. SHA-256 fingerprint of the file sent)
- Technological means toward a party not represented: consent of that party or court order (art. 133, para. 2)
Information to have ready
Case reference, court and jurisdiction, party names, author contact details, relevant dates and your supporting exhibits. Provide verified legal grounds where requested; the tool does not invent authorities or facts.
Review before filing
Confirm that this document is appropriate for the proceeding, use any mandatory official form, check confidentiality and redactions, and complete required signatures, swearing and service. A draft export is not a filing or proof of service.
Category and limits
Complete template to fill in yourself · category A · practice area : Civil litigation · offered in case files of type : Other (small claims, neighbours…), Business, Claim against a municipality, Housing, Civil litigation, Consumer & small claims
Complete template that you fill in for your own file. The fixed text only carries the mentions the cited provisions require; the facts, choices and requests are yours. The tool does not file, serve, swear or send anything, does not choose a remedy or a deadline for you, and guarantees no outcome (Act respecting the Barreau du Québec, s. 128: “to prepare and draw up a notice, motion, proceeding or other similar document intended for use in a case before the courts”, “performed for others”, is the exclusive prerogative of the practising advocate or solicitor).
What the provisions read require
- C.C.P., art. 110 — French text: notification “par tout mode approprié qui permet à celui qui notifie de constituer une preuve de la remise, de l’envoi, de la transmission ou de la publication du document”. (LégisQuébec — Code de procédure civile, C-25.01, read on 2026-10-21)
- C.C.P., art.
- C.C.P., arts.
(TAL — TAL-001-E, Demande (2026-06), read on 2026-10-21)
- TAL — Notification of an application — Proofs suggested by the TAL: signed acknowledgement of receipt; Canada Post delivery confirmation “ET” image of the signature; bailiff’s report (13-02). (Tribunal administratif du logement — Notification d’une demande à l’autre partie, read on 2026-10-21)
Time limits read
- TAL: proof of notification and list of exhibits filed within 45 days after the application is introduced (TAL Act, s. 56.2).
Exhibits and documents
- Canada Post notice of delivery or of receipt; capture of the email sent; fingerprint of the file.
To verify (not read or not settled)
- Delivery by messenger (art. 132, receipt): text not quoted by 13-02.
- This declaration does not replace service by a bailiff where the law requires it (art. 139).
Complete template (category A). C.C.P. arts. 110, 131 and 133-134 are quoted as read by reports 06 and 13-02; the TAL rule comes from the TAL-001-E form re-read on 2026-10-21. A proof records what you did; it says nothing about whether a notification produced its effects. Québec statutes and most Québec sources linked here were read in French; English wording in this guide is an unofficial summary unless an official English text is linked.
Preuve en main is a preparation and legal-information tool. It gives no legal advice, replaces neither a lawyer nor the official form, and guarantees no outcome.
