Originating application (Québec, C.C.P., arts. 99-100, 141)

Prepare an originating application before the Court of Québec or the Superior Court with the mentions of C.C.P. arts. 99 and 100, for your own case.

What you will prepare

  • Court seized, judicial district, file number (once assigned) and date (C.C.P., art. 99); Court of Québec or Superior Court according to the amount (art. 35)
  • Parties: names and domicile or residence; capacity of a party acting otherwise than in its own name (art. 100)
  • Nature and object of the application (art. 99)
  • Facts, numbered consecutively, each linked to its exhibit (art. 99)
  • Anything that, if not stated, could surprise another party or raise an unforeseen debate (art. 99)
  • Conclusions sought (art. 99; compatible conclusions, art. 143)
  • Exhibits in support (P-1, P-2…), also listed in the summons (art. 145)
  • Simplified procedure (Court of Québec, under $100,000): applies or not — if it applies, the application has no more than five pages (art. 535.3)

Information to have ready

Case reference, court and jurisdiction, party names, author contact details, relevant dates and your supporting exhibits. Provide verified legal grounds where requested; the tool does not invent authorities or facts.

Review before filing

Confirm that this document is appropriate for the proceeding, use any mandatory official form, check confidentiality and redactions, and complete required signatures, swearing and service. A draft export is not a filing or proof of service.

Category and limits

Complete template to fill in yourself · category A · practice area : Civil litigation · offered in case files of type : Other (small claims, neighbours…), Business, Claim against a municipality, Civil litigation, Consumer & small claims

Complete template that you fill in for your own file. The fixed text only carries the mentions the cited provisions require; the facts, choices and requests are yours. The tool does not file, serve, swear or send anything, does not choose a remedy or a deadline for you, and guarantees no outcome (Act respecting the Barreau du Québec, s. 128: “to prepare and draw up a notice, motion, proceeding or other similar document intended for use in a case before the courts”, “performed for others”, is the exclusive prerogative of the practising advocate or solicitor).

  • C.C.P., arts. 139-140 — The originating application is served by a bailiff (art. 139), with a copy “certifiée conforme” (art. 140, 13-02). (LégisQuébec — Code de procédure civile, C-25.01, read on 2026-10-21)
  • C.C.P., art. 535.3 — Simplified procedure: the application has “au plus cinq pages” (French text). (LégisQuébec — Code de procédure civile, C-25.01, read on 2026-10-21)
  • Court of Québec rules, arts. 9-10; Superior Court civil rules, art. 3 — Letter format, Arial 12 (C.Q., art. 9); backing (C.Q., art. 10); backing and name, address and postal code of the parties (Superior Court, art. 3) — 13-02. • C.C.Q., art. 2892 — “The filing of a judicial application before the expiry of the prescriptive period constitutes a civil interruption, provided the demand is served on the person to be prevented from prescribing not later than 60 days following the expiry of the prescriptive period.” The application is filed before the period expires; the 60 days are for service (LégisQuébec, up to date as of 15 October 2026, read on 2026-11-03).
