Summons (arts. 145 ff. C.C.P.) — information to transfer onto the Minister’s model
Prepare the information that fills the blanks of the Minister’s mandatory model of summons; you complete the official model yourself.
What you will prepare
- Heading “Dépôt d’une demande en justice”: court (Court of Québec or Superior Court) and judicial district
- Heading “Pièces au soutien de la demande”: list of exhibits P-1, P-2…
- Heading “Réponse à cette demande”: courthouse and its address
- Variant of the headings “Contenu de la réponse” and “Convocation à une conférence de gestion”: the simplified rules apply (amount under $75,000, or from $75,000 to under $100,000 when the plaintiff so chose) or do not apply
Information to have ready
Case reference, court and jurisdiction, party names, author contact details, relevant dates and your supporting exhibits. Provide verified legal grounds where requested; the tool does not invent authorities or facts.
Review before filing
Confirm that this document is appropriate for the proceeding, use any mandatory official form, check confidentiality and redactions, and complete required signatures, swearing and service. A draft export is not a filing or proof of service.
Category and limits
Help preparing the official form · category B · practice area : Civil litigation · offered in case files of type : Other (small claims, neighbours…), Business, Claim against a municipality, Civil litigation, Consumer & small claims
Help preparing the official form: the tool prepares your answers, line by line, and links the official form. You check each line, transfer it onto the official form, sign it and handle any oath, notification and filing yourself. The tool guarantees no outcome.
Official form
The official PDF has no fillable field (0) and Québec government content may not be reproduced without prior authorization (quebec.ca “Droit d’auteur”, updated 10 February 2025, read on 2026-10-21). Research 13-02 had proposed a literal reproduction (category A); it stays in B until that authorization is obtained.
What the provisions read require
- C.C.P., art. 145 — French text: “Le demandeur assigne le défendeur en justice au moyen d’un avis d’assignation joint à la demande, lequel comprend aussi l’indication des pièces au soutien de la demande.” The defendant answers within 15 days. (LégisQuébec — Code de procédure civile, C-25.01, read on 2026-10-21)
- C.C.P., art. 146 — French text: “L’avis d’assignation doit être conforme au modèle établi par le ministre de la Justice.” (LégisQuébec — Code de procédure civile, C-25.01, read on 2026-10-21)
- Minister’s model, order 5016 (20 June 2023) — Model read on 2026-10-21: answer within 15 days of service (30 days without domicile, residence or establishment in Québec); default judgment possible; simplified-rules variant (95 days, 110 days) or ordinary variant (protocol within 45 days, 3 months in family matters; conference within 20 days of the protocol). (Justice Québec — Avis d’assignation (articles 145 et suivants CPC), modèle du ministre, arrêté 5016 du 20 juin 2023, annexe I, read on 2026-10-21)
Time limits read
- Answer within 15 days of service, or 30 days outside Québec (model; C.C.P., art. 145).
Exhibits and documents
- Originating application and its list of exhibits (civ-demande-introductive-qc).
To verify (not read or not settled)
- Authorization to reproduce the Minister’s model: to request from the Government of Québec; it would allow category A.
- English version of the model: NOT READ.
- Each new version of C-25.01, r. 2 must be compared with this list of headings (13-02, P1-2).
Help preparing the official model (category B, downgraded from A for copyright reasons). The model (order 5016, 3 pages, no fillable field) was read on 2026-10-21; C.C.P. arts. 145-146 are quoted as read by reports 06 and 13-02. Québec statutes and most Québec sources linked here were read in French; English wording in this guide is an unofficial summary unless an official English text is linked.
Preuve en main is a preparation and legal-information tool. It gives no legal advice, replaces neither a lawyer nor the official form, and guarantees no outcome.
